I just got done talking to one of the main sales rep/dealers...and he said that they are getting about 10 next week on a first come first serve basis...and the mark up will be anywhere between $40,000-$46,000...you have got to be kidding me!!!...is the car that popular for such a mark up?...I had visited Modesto Nissan two weeks ago and there mark up was $5,000 from the msrp sticker (much more reasonable)...Stockton Nissan has got to be crazy for doing business like that, or maybe they know that people are going to pay no matter what on a first come first serve basis, this is what I was exactly afraid of because the car looks sooo awesome that suckers will pay anything for it...that's ok, things will return back to normal as more and more arrive...or at least I hope so. It is just sickening to see dealers rip off people like that, no offense...I think I will invest in a house first before spending that extra kind of money for a car

I dont believe that any Nissan dealerships can sell above or below the MSRP Nissan USA has set. If they are really marking up the cost, get the pricequote on paper, and submit it to Nissan USA, they should be able to help you and if possible, Ban the sales for Stockton as they do not deserve the rights to sell such a car, and try to take advantage of the sales.... but again, this is what i have heard, so check it out with Nissan USA before doing anything drastic.

Nissan has absolutely no say whatsoever in what retailers can charge for a car. Neither does any other car manufacturer. It's the law, at least in the U.S. (not sure how Saturn gets away with it).
Nissan at one time requested that dealers not charge a market adjustment over MSRP on the Z but that doesn't mean doodly-squat. Retailers are free to charge whatever the market will bear. Don't want to pay that much? Then don't. If someone else will then the retailer is fully justified in charging whatever amount the market will sustain.
Can the dealer sell for over MSRP?

Yes, the dealer can sell for over MSRP. In the United States we are a free market which means the price is what the market will bear.

Yes, they do have the right to attempt to sell for over MSRP, by law. Saturn can do what they do by way of the advertising campaign. If one of the Saturn dealers start to negotiate, their whole system ends up with the rest of the dealerships. However, the corp folk at region level can decide who gets what unit alotments, i.e. stock.

It's up to you to buy or not to buy.
If you want the car and are willing to pay then some dealers are more than willing to take as much as they can get. Most dealers charge MSRP and usually not above but if a dealer can get more, the they will.
I have a 350Z Track Pkg in Orange and Graphite Cloth and I'm getting MSRP, the car has 350 miles and unfortunately was titled so it is "not new/used" but those are the breaks. I'm still getting msrp though. There are none of these 350Z's available in my area so I can get msrp and I'm an Infiniti dealer.
